Acceptance of Terms
By accessing or using Kin-nect (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding legal agreement between you and Kin-nect.
Description of Service
Kin-nect is an automated wellness check-in tool. It places daily phone calls to a person you designate (the "Patient") and provides written call summaries, mood classifications, and concern alerts to the family members or caregivers you authorize.
Kin-nect is not a medical service. It is not an emergency response system. It is not a substitute for professional healthcare, in-person caregivers, or human contact. It is a supplemental tool — nothing more.
NOT A MEDICAL OR EMERGENCY SERVICE
Kin-nect does not provide medical advice, diagnosis, or treatment. Call summaries, mood classifications, and wellness signals are generated automatically by AI and may contain errors, omissions, inaccuracies, or hallucinated content. Do not make medical decisions based on Kin-nect's outputs alone.
Kin-nect is not designed to detect or respond to medical emergencies — including falls, accidents, strokes, heart attacks, overdoses, or any other urgent situation. We do not monitor calls in real time, and our AI is not a substitute for emergency services.
If your loved one has a medical emergency, call 911 (or your local emergency number) immediately. Do not rely on Kin-nect to detect or report emergencies.
Always consult qualified healthcare providers for any medical concerns. Kin-nect should be used as a supplemental tool only, alongside professional care, regular family contact, and dedicated medical alert systems where appropriate.
By using Kin-nect, you acknowledge that you have read and understood these limitations and that you accept full responsibility for ensuring appropriate medical care and emergency response are in place for the Patient.
Account Responsibilities
- You are responsible for keeping your account credentials secure. You are responsible for all activity that occurs under your account.
- You must provide accurate and current information about the Patient.
- You must obtain meaningful consent from the Patient before enrolling them. Enrolling someone in Kin-nect without their knowledge or against their wishes is a violation of these Terms.
- You must be at least 18 years old to create an account or operate Kin-nect on behalf of someone else.
- You must not use Kin-nect to harass, harm, surveil, or otherwise act against anyone without their informed consent.
Subscription and Billing
- Kin-nect is offered as a monthly subscription with an initial free trial.
- iOS users: Subscriptions are billed through your Apple App Store account and auto-renew at the price disclosed at purchase. Manage and cancel through your Apple ID Subscriptions settings. Refunds for iOS subscriptions are handled by Apple per their policies.
- Web users: Subscriptions are billed through Stripe and auto-renew at the disclosed monthly rate. You can cancel at any time using the in-app Cancel Account button. Refunds for web subscriptions are handled by Kin-nect on a case-by-case basis.
- Price changes, if any, will be communicated to you before they take effect.
Apple App Store Terms
The following terms apply to your use of Kin-nect as an iOS app downloaded from the Apple App Store:
- These Terms are between you and Kin-nect only, not with Apple. Apple is not responsible for Kin-nect or its content.
- Apple has no obligation to provide maintenance or support services for Kin-nect. If Kin-nect fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price to you (if any). To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Kin-nect.
- Kin-nect, not Apple, is responsible for addressing any claims you or any third party have relating to Kin-nect, including product liability claims, claims that Kin-nect fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- Kin-nect, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim related to Kin-nect.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
SMS / Text Message Notifications
Program name: Kin-nect.
Program description: Kin-nect sends SMS alerts to the caregiver or emergency contact you designate during signup. Alerts relate to the Patient's daily automated check-in calls and may include flagged health or wellbeing concerns, requests the Patient asks us to relay to you, urgent safety notifications (such as a reported fall), missed-check-in notices, and medication follow-up reminders.
Message frequency: Message frequency varies and is not on a fixed cadence — it depends on the outcome of each check-in call. You may receive no messages on some days and multiple messages on others.
Cost: Message and data rates may apply, depending on your mobile plan and carrier.
Opt-out: Reply STOP at any time to unsubscribe from all Kin-nect SMS alerts. You will receive a final confirmation message acknowledging that you have been opted out.

Carrier disclaimer: Mobile carriers are not liable for delayed or undelivered messages. Delivery of SMS messages is not guaranteed and may be affected by factors outside our control.
LIMITATION OF LIABILITY
Kin-nect is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied. We disclaim all warranties to the maximum extent permitted by law, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and uninterrupted availability.
To the maximum extent permitted by applicable law, Kin-nect, its founders, employees, contractors, suppliers, and service providers shall NOT be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to damages arising from or related to:
- Missed calls, failed call delivery, or interruptions in service
- Inaccurate, delayed, missing, or misleading call summaries, mood classifications, wellness signals, transcripts, or alerts
- Delayed, missing, or erroneous notifications of any kind
- Falls, accidents, injuries, medical emergencies, deterioration of health, hospitalization, or death of the Patient or any other person
- Property damage
- Loss of, corruption of, or unauthorized access to data
- Emotional distress, anxiety, grief, or any other mental or emotional harm
- Any decision, action, or inaction you take based on Kin-nect's outputs
- Any third-party service provider's actions, outages, or failures
Our total cumulative liability to you for any and all claims arising out of or relating to Kin-nect shall not exceed the greater of: (a) the total amount you paid Kin-nect in the twelve (12) months prior to the event giving rise to the claim, or (b) one hundred US dollars ($100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. In those jurisdictions, our liability is limited to the maximum extent permitted by applicable law.
Indemnification
You agree to indemnify, defend, and hold harmless Kin-nect, its founders, employees, contractors, suppliers, and service providers from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of, or inability to use, Kin-nect
- Your violation of these Terms or any applicable law
- Your violation of any rights of another person — including the Patient, other family members, or any third party
- Any decisions, actions, or inactions you take based on Kin-nect's outputs
- Any false, misleading, or inaccurate information you provide to Kin-nect
Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or to Kin-nect — whether based in contract, tort, statute, fraud, misrepresentation, or any other legal theory — shall be resolved through binding individual arbitration administered by JAMS or the American Arbitration Association (AAA) under their applicable rules, conducted in English, in the state where Kin-nect's primary operations are located.
You and Kin-nect waive the right to a jury trial.
You and Kin-nect waive the right to participate in any class action, class arbitration, or representative proceeding. Claims must be brought individually.
Notwithstanding the above, either party may bring an individual claim in small claims court if it qualifies.
Termination
- You may cancel your account at any time by tapping the Cancel Account button on the Profile screen in the iOS app, or by emailing support@kin-nect.app.
- We may suspend or terminate accounts that violate these Terms, that pose a risk to other users, or where required by law — with or without prior notice.
- Upon termination, your data is deleted within 30 days, as described in our Privacy Policy.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will communicate them by email and/or in-app notice before they take effect. Your continued use of Kin-nect after the effective date means you accept the updated Terms. If you do not agree to the updates, you must stop using Kin-nect and cancel your account.
Governing Law
These Terms are governed by the laws of the State of Ohio, USA, without regard to its conflict of law principles. The exclusive venue for any dispute that is not subject to arbitration (or for any small claims action) shall be the state or federal courts located in Ohio, and you and Kin-nect consent to the personal jurisdiction of those courts.
